John Allen: What the EC is doing seems to be reviewing NAMA under the provisions of Articles 107 and 108 in http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:C:2008:115:0047:0199:EN:PDF

107: any aid granted by a Member State or through State resources in any form whatsoever which distorts or threatens to distort competition by favouring certain undertakings or the production of certain goods shall, in so far as it affects trade between Member States, be incompatible with the internal market.

108: On application by a Member State, the Council may, acting unanimously, decide that aid which that State is granting or intends to grant shall be considered to be compatible with the internal market, in derogation from the provisions of Article 107 …..

Of course it’s all larded with a lot of ‘ifs” and ‘buts’.

Did the Council act unanimously in approving NAMA?
